Welcome to Khaitily, an online marketplace connecting customers with shops, designers, and tailors. By accessing or using Khaitily (the “Platform”), you agree to comply with and be bound by these Terms of Service. If you do not agree, you may not use our Platform. These Terms apply to all users, including customers, vendors, and visitors.

1. About Khaitily

Khaitily (“we”, “us”, “our”) operates a digital platform for browsing, purchasing, and offering fashion products, tailoring services, and designer items. Khaitily is not the seller; each vendor is responsible for their own listings, fulfillment, and customer support.

2. Eligibility

To use Khaitily, you must:

  • Be at least 18 years old or have legal guardian approval.

  • Provide accurate registration information.

  • Use the Platform for lawful purposes only.

Khaitily reserves the right to refuse service or close accounts at our discretion if rules are violated.

3. Accounts & Registration

You may register as:

  • Customer – to browse, purchase items, and leave ratings (no comments).

  • Vendor – as a shop, designer, or tailor.

Upon registration, you agree to:

  • Maintain accurate account information.

  • Keep your login credentials secure.

  • Be responsible for all activities under your account.

Khaitily may suspend or terminate accounts engaged in fraud, abuse, or policy violations.

4. Marketplace Role & Responsibilities

Khaitily’s role:

  • Acts as an intermediary platform.

  • Hosts listings and provides payment processing for vendors.

  • Collects commissions and subscription fees from customers and vendors.

Vendor responsibilities:
Vendors are solely responsible for:

  • Accuracy of product descriptions, pricing, and photos.

  • Order fulfillment, delivery timelines, and customer support.

  • Refunds, returns, and dispute handling.

  • Compliance with local laws, copyright, and authenticity requirements.

  • Providing truthful branding and product information.

Vendors may not use Khaitily to redirect customers to other websites for sales. Khaitily is not liable for vendor misconduct or false listings.

5. Subscriptions & Vendor Fees

Vendors may access subscription tiers:

  • Freemium

  • Standard / Premium / Premium Plus / Ultimate

Additional paid upload slots may be available. Subscription tiers may provide reduced commissions. Fees may change with advance notice. Non-payment may result in suspension of vendor privileges.

6. Orders, Payments & Commission

  • Payments are processed securely via approved third-party gateways.

  • By purchasing, customers authorize Khaitily to process payments on behalf of vendors.

  • Vendors authorize Khaitily to deduct commissions automatically per order.

  • Vendor payouts may be temporarily held in cases of:

    • Fraud suspicion

    • Dispute investigation

    • Chargebacks

    • Violation of these Terms

7. Shipping, Delivery & Returns

  • Vendors are fully responsible for:

    • Order preparation

    • Shipping arrangements and timelines

    • Accurate shipping costs

    • Handling returns and exchanges

Khaitily does not provide shipping services and cannot guarantee delivery times. Return and dispute policies may vary by vendor. Khaitily may intervene only to ensure platform compliance.

8. Ratings System

  • Customers may leave 5-star ratings based on genuine purchase experience.

  • Manipulation, fake reviews, or rating purchases are prohibited.

  • Vendors may not pressure customers to change ratings.

  • Khaitily reserves the right to remove fraudulent or suspicious ratings.

9. Intellectual Property

  • All platform branding, design, and technology belong to Khaitily.

  • Vendors must ensure they have the rights to:

    • Product photos

    • Logos and branding

    • Designs and creative content

Copyright violations may result in account suspension.

10. Prohibited Activities

Users may not:

  • Upload illegal, harmful, or misleading content

  • Impersonate others or misrepresent identity

  • Attempt to bypass commissions or subscription fees

  • Engage in harassment, fraud, or abusive conduct

  • Interfere with platform functionality or security

11. Disclaimers

  • The Platform is provided “as is” without warranties of any kind.

  • Khaitily does not guarantee:

    • Vendor reliability

    • Product quality

    • Delivery timelines

    • Error-free or uninterrupted platform availability

Customers purchase at their own risk from independent vendors.

12. Limitation of Liability

To the fullest extent permitted by law:

  • Khaitily is not liable for vendor actions, products, delays, disputes, data loss, profits, or indirect/consequential damages.

  • Our total liability is limited to the lesser of the total fees you paid to Khaitily in the past 6 months.

13. Termination

Khaitily may suspend or terminate access for:

  • Policy violations

  • Fraudulent activity

  • Non-payment of subscriptions

  • Harm to users or the platform

Users may request account deletion at any time.

14. Changes to Terms

Khaitily may update these Terms periodically. Continued use of the Platform indicates acceptance of updated Terms.

15. Governing Law

These Terms are governed by the laws of Kuwait. Any disputes shall be resolved in courts with Kuwait jurisdiction.
